Welcome to Clust! These terms and conditions outline the rules and regulations for the use of the Clust mobile application.
**1. Acceptance of Terms**
By downloading, installing, and/or using the Clust app, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, you must not use our app.
**2. Definitions**
– **”App”** refers to the Clust mobile application.
– **”User”** refers to any individual who downloads, installs, or uses the app.
– **”Driver”** refers to any individual who provides taxi services through the app.
– **”Service”** refers to the taxi services provided through the app.
**3. Use of the App**
– The app is intended for individuals who are at least 18 years old.
– Users must create an account to use the app.
– You are responsible for maintaining the confidentiality of your account information and password.
**4. Booking a Ride**
– Users can book a ride through the app by specifying their pick-up and drop-off locations.
– The app will provide a fixed fare, which is shown to the user before confirming the booking.
– Users agree to pay the fixed fare shown at the time of booking.
**5. Payment**
– Payment for rides can be made through the app using a valid credit/debit card or other approved payment methods.
– Users authorize Clust to charge their payment method for all amounts due, including additional fees for waiting time, tolls, and other charges not included in the fixed fare.
**6. Cancellations and Refunds**
– Users may cancel a ride request at any time before the driver accepts the request without any charge.
– If a ride is canceled after the driver has accepted, a cancellation fee may apply.
– Refunds for completed rides are not guaranteed and will be assessed on a case-by-case basis.
**7. Return and Refund Policy**
– **Service Issues:** If you experience any issues with your ride, such as safety concerns, unprofessional behavior, or significant deviation from the expected service, please contact our customer support within 24 hours of the ride completion.
– **Refund Requests:** Refund requests can be made by contacting our customer support team at [contact email] or through the app’s support section. Provide details of the ride and the reason for the refund request.
– **Assessment:** Refund requests will be assessed on a case-by-case basis. We reserve the right to grant or deny refunds at our sole discretion.
– **Processing Time:** Approved refunds will be processed within 7-10 business days. The refunded amount will be credited back to the original payment method used.
**8. Driver Conduct**
– Drivers are independent contractors and are not employees of Clust.
– Drivers are expected to provide a safe and professional service.
– Users can rate and review drivers through the app.
**9. User Conduct**
– Users agree to use the app in compliance with all applicable laws.
– Users must not misuse the app, harass drivers, or damage vehicles.
– Any misconduct may result in account suspension or termination.
**10. Limitation of Liability**
– Clust is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the app or services.
– Clust does not guarantee the availability, accuracy, or reliability of the app or services.
**11. Privacy Policy**
– Your use of the app is also governed by our Privacy Policy, which outlines how we collect, use, and protect your information.
**12. Changes to Terms**
– Clust reserves the right to modify these terms at any time. Changes will be effective upon posting on the app.
– Continued use of the app after any changes constitutes acceptance of the new terms.
